医薬品は他業界と比較し少ない特許で製品が保護されているとされ、その中で最も強い特許とされているのが、化合物自体を特許権で保護する物質特許と呼ばれるものになります。

さて、そのような重要な物質特許なので、製薬企業は特許性を確保すべく万全の体制で臨んできます。
しかし、今回製薬業界最大手のファイザー社の主力製品のひとつであるゼルヤンツ(tofacitinib)の物質特許が、ロシア現地のジェネリック企業PSK Pharmaが、特許庁での無効手続きに成功したようです!
特許はEurasian patent for invention No. 6227とありますので、こちらですかね。
ニュースレターによると、新規事項追加、新規性・進歩性欠如を理由とする特許無効が現地ジェネリック企業から主張されていたそうですが、最終的に何で無効にされたかニュースレターでは不明です。。。

また、今回のロシア特許庁の決定には、ウクライナ危機を契機にロシアで制定された「非友好国」の外国企業が保有する知的財産権に影響を与える最近の法律とは無関係であるそうです。
