AIが書いた絵を使えるMidjourneyが最近話題になっているようです。
こちらの著作権の規約ですが、記事によると、原則はユーザーがAI著作物の著作権の権利を有し、一定のものについてMiidjourneyに利用許諾を行うという構成のようです。
まず当たるべきは、Midjourneyの利用規約である。利用規約のCopyrightの項目には、概ね以下のように記されている（筆者抄訳）。
- ユーザーがMidjourneyに与える権利
”ユーザーが本サービスに入力したテキスト、イメージプロンプト、生成物云々等を、複製、派生物の作成、公的に掲示、配付するための権利および著作権を許諾する”
- ユーザーの権利
”上記のライセンスに同意する限り、本サービスを利用して作成したすべての資産を所有する”
細かい例外規定も書かれているが、大筋はこうなっている。これはSNS等の規約と似た設計だ。Midjourneyで作られた画像は、基本的にユーザー側がすべての権利を保つが、サービス側が自由に使うことがありますよ、と。

ちなみに、2022年8月11日時点の規約はこちらです。
とはいえ、いくつか記事に指摘されているように、例外があるようです。
(1)公共の場に画像などを投稿したとき
まず画像等が公共の場に投稿等された場合は、他の人も使用などを許すことが原則になるようです。ただし、private planの場合は一部さらに例外があるようです。
Please note: Midjourney is an open community which allows others to use and remix your images and prompts whenever they are posted in a public setting. By default, your images are publically viewable and remixable. As described above, you grant Midjourney a license to allow this. If you purchase a private plan, you may bypass some of these public sharing defaults.
(2)非有料会員
非有料会員はCreative Commons Noncommercial 4.0 Attribution International License (CC BY 4.0) の条件に従うそうです。
Exception 1: Non-Paid Members License Terms
If you are not a Paid Member, Midjourney grants you a license to the Assets under the Creative Commons Noncommercial 4.0 Attribution International License (the “Asset License”).

(3)企業ユーザー
企業ユーザーは、企業ユーザーのライセンス条件に従う必要があるそうです。
Exception 2: Corporate-User License Terms
If you are an employee or owner of a company with more than $1,000,000 USD a year in gross revenue, and you are using the Services to benefit your Employer or company you must purchase a corporate membership plan to use the Services or copy the Assets for your company.
Corporate membership plans involve an upfront, non-refundable deposit for up to 12 months of service.
また、AIが学習時に他人の著作物を利用したり、出力結果が他人の著作物と類似したときなどどうするかといった問題点も指摘しています。
加えて記事では、別の視点も指摘している。それは、AIが学習する過程に置いて、著作権で保護されている画像を使用していることで、ジェネレートしたユーザーに著作権侵害の可能性が及ぶか、という視点だ。

出力のときは依拠性が認められるかが一つ論点になるのかもしれないですね。
