OpenAIが開発した、GPT-3.5という自然言語モデルをベースにしたチャットAIであるChatGPTが衝撃を与えています。
色んな内容を回答してくれるのはもちろんですが、プログラマーの方はコードを聞いたりして参考にするなど、様々な用途があるそうです。
法律業界でもどんな影響があるのか記事も出始めています。
さて、知的財産の観点では、便利なAIがいろいろ出てくるようになっていますが、機密保持は注意点です。
Amazonでは注意喚起がでていますが、ChatGPTに機密情報等を共有しないように注意が必要です。
特にChatGPTは生成系AIで学習データを元に新たな文書を作りますので、機密情報を学習させてしまうと、その機密情報を元に第三者に新たな文章が作られ、情報漏洩してしまうリスクがあるといえそうです。
実際、ニュース内で、「ChatGPTがAmazonの社外秘であるはずのデータに非常に似たレスポンスを出したのをAmazon関係者が目撃したとし、社内での懸念が高まった」と言っているので、注意が必要かと思われます。コードの場合はセキュリティホールの原因にもなりえるかもしれません。
Q&Aにおいても、開発元のOpenAIは、ChatGPTに打ち込んだ質問文は消すとこができないとし、機密情報などは質問文で打ち込まないよう記載しています。

さらに利用規約を見ると、入力した質問文等をChatGPTの学習に使用することの同意が含まれています。一定の場合でopt outがあるそうですが、どこまで可能か(本当に信用するか含めて)は使用前に確認しておく必要があるかもしれません。
